Online store rules
The Rules define the general conditions and procedures for sales carried out by heelshub.com, located in Ukraine, through the Online Store www.heelshub.com (hereinafter – the Online Store), and define the terms and conditions of services provided by heelshub.com through free electronic services.
1. Definitions
1.1. Business days are days from Monday to Friday, excluding public holidays.
1.2. Delivery means the actual delivery of Products to the Customer by the Seller through the Supplier specified in the order.
1.3. Supplier is a person or company cooperating with the Seller in the delivery process, including courier companies.
1.4. Password is a sequence of letters, numbers or symbols chosen by the Customer during Registration to secure access to the Customer Account.
1.5. Customer is a natural or legal person using electronic services provided by the Seller.
1.6. Consumer is a natural person entering into a legal transaction not directly related to business or professional activity.
1.7. Customer Account is an individual account created after Registration, allowing access to Store functions.
1.8. Entrepreneur is a natural or legal person conducting business or professional activity.
1.9. Rules are these Terms and Conditions.
1.10. Registration is the procedure required to access Store functions.
1.11. Seller is heelshub.com, headquartered in Dnipro, Ukraine (49000), email: info@heelshub.com.
1.12. Store Website means websites operated by the Seller under the domain www.heelshub.com.
1.13. Products are goods offered by the Seller through the Store Website.
1.14. Durable Medium is a medium enabling storage of information for future access without alteration.
1.15. Sale and Purchase Agreement is an agreement concluded remotely between the Customer and the Seller.
2. General Regulations and Use of the Online Store
2.1. All rights to the Online Store, including intellectual property rights, belong to the Seller.
2.2. The Seller makes every effort to ensure proper functioning of the Store on popular browsers and devices.
2.3. The Store uses cookies to ensure correct operation. Disabling cookies may affect functionality.
2.4. To place orders online or by email, the Customer must have an active email address and phone number.
2.5. Orders by phone require a valid phone number and email address.
2.6. Illegal use of the Store or posting unlawful content is prohibited.
2.7. The Seller never requests the Customer’s password.
2.8. Using the Store for advertising third-party products or posting misleading content is prohibited.
3. Registration
3.1. Registration is free and optional.
3.2. Registration is not required to place an order in the Online Store.
3.3. To register, the Customer must complete the registration form available on the Store Website and submit it electronically.
3.4. During Registration, the Customer sets an individual Password.
3.5. By registering, the Customer confirms that they have read and accepted these Rules.
3.6. The Customer may consent to the processing of personal data for marketing purposes. Such consent may be withdrawn at any time.
3.7. After successful Registration, the Customer receives confirmation by email and gains access to the Customer Account.
4. Orders
4.1. Information presented on the Store Website does not constitute a binding offer within the meaning of the Civil Code.
4.2. Orders may be placed via the Store Website or by email 24 hours a day, 7 days a week.
4.3. Orders by phone are accepted during hours specified on the Store Website.
4.4. When placing an order via the Store Website, the Customer selects Products and adds them to the cart using the “BUY” button.
4.5. Before submitting an order, the Customer is informed of the total price, including delivery and additional costs.
4.6. When placing an order by phone, the Customer provides product details, delivery address, and payment method.
4.7. When placing an order by email, the Customer must specify the product name, color, quantity, and contact details.
4.8. Placing an order constitutes an offer to conclude a Sale and Purchase Agreement.
4.9. The Agreement is concluded when the Seller confirms acceptance of the order.
4.10. Order confirmation and delivery details are sent to the Customer’s email address.
5. Payment
5.1. Prices listed on the Store Website do not include delivery costs.
5.2. Available payment methods include:
5.2.1. Online payment via WayForPay.
5.2.2. Bank transfer to the Seller’s bank account.
5.3. Payment must be completed within 3 business days for prepaid orders.
5.4. Failure to make payment within the specified period may result in order cancellation.
6. Delivery
6.1. Delivery is available within the United States of America and Europe.
6.2. The Seller undertakes to deliver Products free from defects.
6.3. Estimated delivery times are indicated on the Store Website in business days.
6.4. Products are delivered via the Supplier to the address specified by the Customer.
6.5. On the shipment date, the Customer receives a dispatch confirmation email.
6.6. The Customer must inspect the parcel upon receipt and report any damage.
6.7. VAT invoices are issued upon request for Customers purchasing as Entrepreneurs.
7. Seller’s Warranty
7.1. The Seller is liable for physical and legal defects of Products.
7.2. In case of defects, the Customer may request repair, replacement, price reduction, or termination of the Agreement.
7.3. Warranty claims are valid for 2 years from the date of delivery.
7.4. Complaints are processed within 14 days from receipt.
8. Manufacturer’s / Distributor’s Warranty
8.1. Products may be covered by a Manufacturer’s or Distributor’s warranty.
8.2. Warranty details are provided on the Store Website where applicable.
9. Sale and Purchase Agreement Termination
9.1. A Consumer may withdraw from the Agreement within 14 days without giving reasons.
9.2. The withdrawal period starts from the date the Product is received.
9.3. Returned Products must be sent back within 14 days from withdrawal.
9.4. Refunds are issued within 14 days after receipt of returned Products.
9.5. The Consumer bears the direct cost of returning Products.
10. Free Services
10.1. The Seller provides free electronic services including:
10.1.1. Contact Form.
10.1.2. Newsletter.
10.1.3. Customer Account.
10.1.4. Reviews.
10.2. Free services are available 24/7.
10.3. The Customer may cancel free services at any time.
11. Responsibility for Content
11.1. Content published by Customers reflects their personal opinions.
11.2. The Seller is not responsible for Customer-generated content unless notified of violations.
11.3. The Seller may remove content that violates applicable law or these Rules.
12. Reporting Violations
12.1. Any person may notify the Seller of content that violates rights or law.
12.2. Upon notification, the Seller will promptly remove infringing content.
13. Personal Data Protection
13.1. Personal data processing rules are defined in the Privacy Policy.
14. Termination of Electronic Services
14.1. Both parties may terminate electronic service agreements at any time.
14.2. Termination does not affect rights acquired before termination.
15. Final Provisions
15.1. Polish law applies to dispute resolution.
15.2. The Seller reserves the right to amend these Rules.
15.3. Amendments enter into force 7 days after publication on the Store Website.
15.4. These Rules enter into force on 01.01.2024.
